NORTH MYRTLE BEACH — An amendment to North Myrtle Beach’s noise ordinance that targets loud music containing “obscene and vulgar” lyrics was passed by City Council.

City officials said they received numerous complaints about an unnamed business on Main Street broadcasting music over the summer that they said many consider to be offensive.

“Several of the persons complaining about the lyrics indicated they could be heard as they were walking on the public sidewalks on Main Street accompanied by their underage children and/or grandchildren,” the city said. “Subjecting non-consenting adults and children to obscene, vulgar and/or profane lyrics as they go about their business while on Main Street (or any other area of the city) is inconsistent with the city’s identity as a family-friendly and family-oriented location.”

Officials said they are aware that the music in question is protected by the First Amendment so to that end, they amended the noise ordinance to impose a maximum decibel level, according to the time of day, at which obscene, vulgar or profane lyrics can be played.

The unanimously passed amendment says music that contains obscene, vulgar, or profane lyrics cannot be played above 30 decibels from 7:01 a.m. to 10:59 p.m. and 50 decibels from 11 p.m. to 7 a.m.

Music or other noise that does not fall into the description of vulgar is limited to 60 decibels from 11 p.m. to 7 a.m. and 80 decibels from 7:01 a.m. to 10:59 p.m.

Council said it will consider making some minor amendments to the new noise ordinance, upon review of proposed edits submitted from the business community.

Businesses or members of the public who violate the ordinance could face up to a $500 fine or 30 days in jail.
